¶1Mr. Ashok Kumar Singh, learned counsel for the petitioners, Mr. Shiv Prakash Gupta, learned counsel for the respondent nos.2 and 3 and learned Standing Counsel for the State are present.

¶2At the very outset, Mr. Shiv Prakash Gupta, learned counsel for the respondent nos.2 and 3 submits that there is an alternative efficacious remedy of revision as provided under section 41(3) of the U.P. Urban Planning and Development Act, 1973.

¶3With the consent of learned counsel for the parties, this writ petition is being finally disposed off at this stage without calling for a counter affidavit.

¶4In view of above, the writ petition is dismissed on the ground of alternative remedy as provided under the law.

¶5However, it is provided that in case the revision is preferred by the petitioner within three weeks from today, the same shall be decided by the competent authority on merit in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of three months from the date of production of a certified copy of this order, if there is no other legal impediment, without raising any objection with regard to limitation.
