Judgment
Court No. - 1 Case :- MATTERS UNDER ARTICLE 227 No. - 7847 of 2023 Petitioner :- Hubni (Deceased) And 4 Others Respondent :- Jokhu (Deceased) And 6 Others Counsel for Petitioner :- Kashi Nath Singh Yadav Hon'ble Jayant Banerji,J. Heard learned counsel for the petitioner. This petition has been filed seeking the following relief:- "It is, therefore most respectfully prayed that this Hon'ble Court may graciously be pleased to issue direct the learned Additional Civil Judge (Junior Division), 2nd Jaunpur to decide the Case No. 535 of 1986 (Hubni Vs. Jokhu and others), within certain stipulated period of time as fixed by this Hon'ble Court. And/or may pass such other and further orders and direction as this Hon'ble Court may deem fit and proper, in the facts and circumstances of the case." It is contended by learned counsel for the petitioner that the aforesaid original suit was filed seeking a decree of permanent injunction and it is a very old case which is yet to be decided. I have perused the record of this petition. Under the circumstances, it would not be appropriate to issue any specific direction upon the court concerned. However, considering that the suit is of the year 1986, this Court requires the trial court to ensure that the suit proceedings are brought to its logical conclusion, without entertaining unnecessary adjournments from the parties, in case there is no legal impediment in proceeding further and all the parties are duly served with notice of the proceeding. With the aforesaid observation, the petition is disposed of. Order Date :- 17.10.2023 A. V. Singh (Jayant Banerji, J.) High Court of Judicature at Allahabad
