Judgment
Court No. - 81 Case :- HABEAS CORPUS WRIT PETITION No. - 793 of 2023 Petitioner :- Bhunesh Kumar And Another Respondent :- State of U.P. and Another Counsel for Petitioner :- Jay Prakash Yadav Counsel for Respondent :- G.A. Hon'ble Mrs. Jyotsna Sharma,J.
¶1Heard Sri Jay Prakash Yadav, learned counsel for the petitioners and Sri Himanshu Kumar, learned AGA for the State.
¶2This petition has been filed on behalf of petitioner no. 2-Parul (corpus), through her father with a prayer that respondent no. 2 be directed to produce his daughter, who is allegedly under his illegal detention.
¶3Learned AGA, on the basis of instructions, submits that petitioner no. 2-Parul (corpus) and respondent no. 2-Lalu Yadav have got married and they are staying as husband and wife. They filed a petition before this High Court i.e., WRIT - C No. - 26103 of 2023 for directing the respondents not to interfere in their peaceful marital life. The High Court allowed the petition, directing the police authorities to see that the respondents shall not interfere in the marital life of the petitioners.
¶4This habeas corpus writ petition is nothing, but an attempt to interfere in the marital life of the petitioner no. 2 and respondent no. 2, through a legal procedure.
¶5In view of the above, I do not find any good ground to entertain this habeas corpus writ petition, hence it is dismissed. Order Date :- 17.10.2023 #Vikram/- High Court of Judicature at Allahabad
