¶1Heard Sri Janardan Shukla, learned counsel for the petitioner and Sri Brijesh Kumar Srivastava, learned Standing counsel appearing on behalf of respondent nos. 1 to 4 as well as Sri Sudhir Bharti, learned counsel for respondent no. 5.

¶2Present petition has been filed seeking a direction in the nature of mandamus to be issued in favour of the respondent no.2 and 4 to remove the illegal encroachment made over arazi nos.210 and 217Ka which are recorded as pond in the revenue records.

¶3Today when the matter has been taken up, learned Standing Counsel came up with the specific instructions which is taken on record through which it has been transpired that after demarcation of the aforesaid plots, it has been found by the revenue team that over plot no.210, illegal encroachment was carried out by some encroachers against which proceedings under Section 67 of the U.P. Revenue Code, 2006 has already been initiated. In sofar as gata no.217ka is concerned, no encroachment has ever been carried out over the said land.

¶4The grievance of the petitioner has already been redressed in pursuance to the prayer as made in the instant petition and as such, there is hardly any cause of action arises in favour of the petitioner to pursue the instant petition.
