¶1Heard learned counsel for the applicant, learned AGA for the State, Shri Om Prakash Vishwakarma, learned counsel for the opposite party no. 2 and perused the record.
¶2Learned counsel for the applicant has submitted that opposite party no.2 is the wife of applicant and she had filed an application under Section 125 CrPC for grant of maintenance, which was allowed by the court below vide order dated 14.03.2019 and the applicant was directed to pay a sum of Rs.2,000/- per month to opposite party no.2 from the date of filing of application till the date of order and thereafter, to pay a sum of Rs.3,000/- per month to opposite party no.2 from the date of order.
¶3Learned counsel for the applicant has next submitted that a sum of Rs.99,000/- stands due to the opposite party no.2 and the applicant is ready to pay the entire due amount but in installments.
¶4Learned counsel for the applicant has next submitted that a demand draft no. 862100 dated 05.09.2023 for an amount of Rs. 50,000/- in the name of opposite party no.2 has also been prepared, which is being handed over to the opposite party no.2, who is present in Court, being the part payment of due amount.
¶5Applicant is directed to pay balance amount of Rs. 49,000/- to opposite party no.2 in four equal installments, payable on 17.11.2023, 18.12.2023, 18.01.2024 and
19.02.2024, together with an amount of Rs.3,000/-, which is directed to be paid monthly.
¶6Till 19.02.2024, interim order dated 18.09.2023, as extended from time to time, is extended.
¶7In case of any default, the said interim order shall stands vacated.
