¶1Heard Mr. Vijay Pratap Yadav, Counsel for the petitioner and Mr. Sanjay Kumar Srivastava, learned State Law Officer for State-respondents.

¶2The instant writ petition has been filed praying for a mandamus directing respondent No.2, Tehsildar, Tehsil-Ghosi, District-Mau to decide the case No. 836 of 2023, Computerized case No. T202315510200836 (Tripurari Vs. Kailash) under Section 34 of U.P. Revenue Code, 2006 within stipulated period.

¶3Counsel for the petitioner submitted that the aforesaid mutation case is pending before respondent no.2 since

1.3.2023 for adjudication. He further submitted that Rule 34

(7) of the U.P. Revenue Code, Rules 2016 provides for disposal of the contesting mutation case within period of 90 days .

¶4Copy of the order sheet has been annexed as Annexure No.2 to the writ petition in order to demonstrate that the case is not proceeding expeditiously.

¶5Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to respondent No.2, Tehsildar, Tehsil-Ghosi, District-Mau to consider and decide the aforementioned mutation case in accordance with law expeditiously and preferably within a period of three months from the date of production of certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties.
