Judgment
Chief Justice's Court Case :- WRIT - C No. - 35904 of 2023 Petitioner :- Raseed @ Raseeda (Since Deceased) And 7 Others Respondent :- State of U.P. and Another Counsel for Petitioner :- Prateek Kumar,Gaurav Gupta Counsel for Respondent :- C.S.C.,Aditya Bhushan Singhal Hon'ble Pritinker Diwaker,Chief Justice Hon'ble Ashutosh Srivastava,J. Heard Sri Prateek Kumar, learned counsel for the petitioner, Sri Aditya Bhushan Singhal, learned counsel, who has put in appearance on behalf of respondent no.2 and learned Standing Counsel appears for the State-respondents. The grievance of the petitioners as raised in the present writ petition is that though a plot has been earmarked in favour of the petitioners by respondent no.2, however, the allotment letter as also the lease-deed has not been executed in favour of the petitioners. Learned counsel for the petitioners submits that for the said purpose, he has already moved several representations, lastly on 14.9.2023. He, however, submits that the purpose of filing the present petition shall stand served, if a direction is issued to respondent no.2 to consider and pass appropriate orders on the pending representation of the petitioners dated 14.9.2023. Sri Aditya Bhushan Singhal, learned counsel for respondent no.2, has no objection to the aforesaid proposition. This Court is of the opinion that no useful purpose shall be served by keeping the writ petition pending and it is, accordingly, disposed of by requiring respondent no.2 to seize with the pending representation of the petitioners dated 14.9.2023 and consider all aspects of the matter and pass appropriate orders expeditiously, preferably within eight weeks from the date of service of certified copy of this order. Needless to say, we have not expressed any opinion on the merits of the claim of the petitioners and it shall be open for respondent no.2 to pass appropriate orders strictly, in accordance with law.
