Sri Suneel Kumar Rai, learned counsel for the petitioner, learned Standing Counsel for the State-Respondent and Sri Kaushlendra Nath Singh, learned counsel for Respondent No. 2. Grievance of the petitioner is that in the year 1982, he has constructed a house over the land in question allotted to him by the Gaon Sabha. Petitioner is aggrieved by the order dated 22.08.2023, whereby Respondent No. 2 has directed for demolition of the said house. Learned counsel for the petitioner submits that he has already made a representation before the Respondent No. 2 and purpose of filing this petition would be served if his pending representation is decided in an objective manner. Learned counsel for the respondent has no objection to this proposition. Without expressing any opinion on the merits of the case, the writ petition is disposed of expecting the Respondent No. 2 to decide the pending representation of the petitioner, if not already decided, in accordance with law as expeditiously as possible preferably within a period of three weeks from the date of production of certified copy of this order. Till four weeks from today, no coercive action shall be taken against the petitioner.
