¶1Heard learned counsel for the petitioner, learned Additional Chief Standing Counsel for the State-respondents and perused the record.

¶2In view of the order proposed to be passed, issuance of notice to the respondent no.3 is dispensed with.

¶3By means of present writ petition the petitioner has sought following principal reliefs:- "(i) A writ order or direction in the nature of mandamus directing to the respondent no.1 and 2 to conclude the enquiry against the respondent no.3 according to service Rules and Act and direct the respondent authorities to decide the application dated 08.08.2023 of the petitioner within short span of time.

(ii) Any order or direction which this Hon'ble Court may deem fit and proper of circumstances of the case.

¶3So far as the grievance of the petitioner is concerned, this Court finds that the petitioner has already filed application dated

08.08.2023 before the Principal Secretary, Irrigation Department, U.P. at Lucknow (respondent no.1) for redressal of his grievance, which is still pending consideration.

¶4No useful purpose would be served in keeping the writ petition pending.

¶5In view of above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the Principal Secretary, Irrigation Department, U.P. at Lucknow (respondent no.1) to decide the petitioner's application strictly in accordance with law after hearing all the stakeholders in the matter within a period of six weeks from the date of production of a certified copy of this order before him.
