¶1Heard learned counsel for the petitioner and Sri R.M.Upadhayay, learned Additional Chief Standing Counsel for the State-respondent.

¶2The present writ petition has been preferred for quashing the order dated 5.6.2023 passed by the respondent no. 3 i.e. Sub Divisional Magistrate Sikarpur, Bulandshahar, whereby, he has directed to constitute a revenue team headed by Naib Tehsildar and initiate necessary proceedings in accordance with law.

¶3In response to the earlier order, learned Additional Chief Standing Counsel has placed the detailed instructions sent by Sub Divisional Magistrate concerned, which is taken on record. He submits that in response to the order dated

5.6.2023, the revenue team was constituted and the measurement took place on the spot and the claim qua the petitioner is already settled by the revenue team. In case, the petitioner has any grievance, she can agitate under U.P.Revenue Code 2006 before the appropriate Forum/Court.

¶4Considering the facts and circumstances of the case and in view of the categorical instructions, we are not inclined to proceed on merit. Needless to say, it is always open for the petitioner to press the relief before the appropriate Forum/Court as per law.
