Court No. - 79 Case :- CRIMINAL REVISION No. - 4436 of 2023 Revisionist :- Smt. Shayara And Another Opposite Party :- State of U.P. and Another Counsel for Revisionist :- Sanjay Kumar Dubey Counsel for Opposite Party :- G.A. Hon'ble Vipin Chandra Dixit,J. Heard learned counsel for the parties and perused the record. This revision has been filed by revisionists with the prayer to set aside the order dated 31.05.2023 passed by Special Judge, S.C./S.T. Act, Hathras in S.T. No.240 of 2023 (State Vs. Chand Miya and others) arising out of Case Crime No.186 of 2021 under Sections 147, 148, 452, 323, 149, 504, 506 I.P.C., Police Station Sikandrarau, District Hathras by which discharge application filed by revisionist was rejected. After arguing the case for quite some time at length, learned counsel for the revisionists submits that the revisionists do not want to press the prayer for setting aside the order rejecting discharge application and the purpose of his client would suffice, if a direction may be given to the courts below to decide the bail application within specific time frame. However, it is directed, that in case revisionists appear and surrender before the court below within a period of one month from today and apply for bail the court below shall consider and decide the bail prayer of applicants expeditiously in accordance with law laid down by Hon'ble Apex Court in the case of Satender Kumar Antil vs. Central Bureau of Investigation & Anr. reported in (2021) 10 SCC 773. With the above directions, the present revision is disposed off. Order Date :- 17.10.2023 Imtiyaz High Court of Judicature at Allahabad
