¶1Heard Mr. Brijendra Kumar, Advocate holding brief of Mr. Prem Chandra Patel, learned counsel for the petitioner and Mr. Govind Kumar Saxena, learned Additional Chief Standing Counsel for the State-respondents.

¶2The instant public interest litigation has been filed for mandamus directing respondents to order for removal of encroachment in respect to the plot which is recorded as banjar in the revenue records.

¶3This Court on 3.10.2023 has directed the learned Standing Counsel to obtain instruction in the matter.

¶4Learned Additional Chief Standing Counsel has placed the instruction dated 20.7.2023 before the Court, which is taken on record.

¶5Learned Additional Chief Standing Counsel on the basis of instruction dated 20.7.2023 submitted that in respect to the plot in dispute five cases have been registered against the persons who are in possession over the same. ¶6In view of the facts mentioned in the instruction dated

20.7.2023, the instant public interest litigation is finally disposed of directing the Tahsildar, Mariyahun, District-Jaunpur to conclude the proceeding of aforementioned five cases pending under Section 67 (1) of U.P. Revenue Code, 2006, expeditiously preferably within a period of six months from the date of production of certified copy of this order before him.
