¶1Heard Sri Ripu Soodan Yadav, learned counsel for the applicant and Sri Padmakar Rai, learned A.G.A. for the State.

¶2The present application has been filed for quashing of the non bailable warrant dated 28.07.2022 and Sessions Trial No. 203 of 2018 (State Versus Vikas Yadav and others) arising out of Case Crime No. 0047 of 2018, under section 147, 148, 323, 504, 506, 342 I.P.C., and 3(2) Va S.C./S.T. Act, Police Station Sarayinayat, District Allahabad, pending in the court of Additional District Judge-15, Allahabad.

¶3Learned counsel for the applicant submits that the applicant has been released on bail in 2019, thereafter, he could not appear before the court due to Covid-19 Pandemic. Subsequently, NBW was issued against him on 28.07.2022.

¶4Learned counsel for the applicant submits that the applicant wants to surrender and apply for bail, therefore, necessary directions may be issued for expeditious disposal of his bail application.

¶5Considering the aforesaid submission, the present application is disposed of with a direction that if the applicant surrenders and moves an application for bail before the court below within 15 days from today, then his application shall be considered in view of the law laid down in Satendra Kumar Antil vs. Central Bureau of Investigation and Another, (2021) 10 SCC 773.

¶6For a period of three weeks or till disposal of the bail application, whichever is earlier, no coercive action shall be taken against the applicant. Order Date :- 17.10.2023 K.K. Maurya High Court of Judicature at Allahabad
