¶1Heard learned counsel for the petitioner and Shri Devansh Rathore, learned Additional Chief Standing Counsel for the State-respondents.

¶2The petitioner has prayed for the following reliefs :- "(i) Issue a writ, order or direction in the nature of mandamus directing the respondent no. 3 & 4 to issue no-objection certificate to the petitioner enabling him to submit the same before the prescribed Authority, Department of Food Safety and Drug Administration Office, situated in Azamgarh, within stipulated period of time.

(ii) Issue a suitable writ, order or direction in the nature of mandamus directing the respondent no. 3 and 4 to decide the representation of the petitioner dated 14.08.2023 by passing a reasoned and speaking order, as soon as possible, within stipulated period of time.

(iii) Issue a suitable writ, order or direction in the nature of mandamus directing the respondent no. 2 to issue a valid license in favour of the petitioner enabling him to run his Buffalo Meat Shop, in pursuance of his online application for obtaining license from the office of respondent no. 2 dated 12.08.2023."

¶3Learned Additional Chief Standing Counsel raised an objection that till date, the petitioner has not submitted NOC from the Department which is required for processing the application for running the meet shop. He submits that, in case, NOC is submitted to the competent authority, the same would be processed as per law.

¶4Considering the facts and circumstances, without adverting to the merits of the case, the petitioner is at liberty to move an appropriate application before the prescribed authority for according NOC and the same is processed by the Department and the same is furnished to the competent authority for according permission to run the meet shop.
