¶1Heard Sri Udai Shankar Chauhan, learned counsel for petitioner and learned Standing counsel for State respondents.

¶2The instant petition has been preferred seeking direction in nature of mandamus commanding respondents to remove illegal encroachment made by respondent no. 6 and 7 over the plot no.

ङarea 0.0280 hectare which is recorded in the name of Irrigation Department, Division, Ghazipur situated at Mauja Maira Sophipur, Tehsil Sadar, District Mau.

¶3Today when the matter has been taken up, learned Standing counsel came up with specific instructions which is taken on record through which it transpired that demarcation was carried out over the plot no. 188

ङarea 0.0280 hectare by revenue authorities on dated 06.10.2023 after which it was found that over the said plot encroachment is made by one Arvind son of Radhe and another and pursuant to that notice under Section 71 of Canal Act, 1873 has been issued against the encroachers and as such grievance of petitioner has already been redressed.

¶4In view of the aforementioned facts and circumstances, no cause of action further survives for petitioner to further pursue the instant P.I.L and the same stands disposed of. Order Date :- 17.10.2023 Shaswat High Court of Judicature at Allahabad
