¶1The petitioner purchased the property in question which is situate over plot no. A-1 /313, Badri Awas Yojna, Prayagraj on

10.07.2014. It is the case of the petitioner that after he purchased the property in question he had paid the electricity bills. However, upon receiving a recovery certificate which has been sent upon his address the petitioner has approached this Court. It is the contention of the learned counsel for the petitioner that the recovery was against one Tarkeshwar Pandey but wrongly it has been sent on the address of the petitioner, therefore, no recovery was possible.

¶3Under such circumstances, we direct that the petitioner may file a fresh application before the respondent No. 5 within a period of two weeks and the respondent No.5 would decide the application within the next of two weeks. For a period of one month or till the decision is taken by the Executive Engineer whichever is earlier no coercive action shall be taken against the petitioner.

¶4With these observations, the writ petition is, accordingly, disposed of. Order Date :- 17.10.2023 vkj High Court of Judicature at Allahabad
