Hon'ble Dr. Gautam Chowdhary,J. Heard Sri Mahendra Singh, learned counsel for the applicant, learned counsel for the State and perused the material on record. This bail application under Section 439 of Code of Criminal Procedure has been filed by the applicant Narayan Singh, seeking enlargement on bail during trial in connection with Case Crime No. 412 of 2019, under sections 147, 148, 149302, 120-B IPC, P.S. Harduaganj, District Aligarh. The submission advanced by learned counsel for the applicant is that the applicant is innocent and has been falsely implicated in the present case due to ulterior motive. According to post mortem examination report the cause of death of the deceased is due to ante mortem head fire arm injury. The applicant is witness of the charge sheet. In the present case the brother of the applicant has lodged an FIR in case crime No. 459 of 2013 but thereafter, after the lapse of five years a complaint of the incident has also been filed in the year 2019 in respect of the incident which took place 2013. In the present case investigation has been done and after investigation charge sheet has been submitted which is annexed at pages 33-41 of the paper book. During investigation the informant has stated that he was walking with the deceased, but all of sudden 6-7 persons came and shot dead the deceased, he was taken to the hospital, where he was declared brought dead. But the informant has not named the applicant in the first information report. Therefore the final report has been submitted on 04.06.2018.
