31.05.2023 passed in Election Revision No. 69 of 2022, 'Salim v. Election Officer and others', vide which the matter has been remanded back before the Prescribed Authority to be heard afresh. Learned counsel for the petitioner submits that the order impugned has been passed without recording any reason in an arbitrary and mechanical manner. Sri Rahul Krishna Agarwal, learned counsel for the respondents submits that it is only a remand order and the matter would be decided on merits, thus, the instant writ petition is misconceived. On the aforesaid, learned counsel for the petitioner prays to withdraw the writ petition. In view of the above, the writ petition is dismissed as withdrawn. No order as to costs.
