¶5Counsel for the informant has vehemently opposed the bail application and has submitted that two bail applications of the applicant have already been rejected by this Court by reasoned orders. The bail application of co-accused, Ratan Yadav alias Ambuj Yadav, was rejected by this Bench on 17.02.2023 and hence the bail application of the applicant deserves to be rejected.
¶6Learned A.G.A has also opposed the submission of the bail application.
¶7After hearing the rival contentions, this Court finds that the earlier bail applications of the applicant and co-accused, Ratan Yadav alias Ambuj Yadav, were rejected by this Court prior to the recording of the statement of the injured witness, P.W.2, Tameshwar Mishra and P.W.3, Abhishek Mishra. They have not assigned the role of causing murder of the deceased, Anuj to the applicant. P.W.4, Deepak Mishra, has also not assigned role of causing murder of the deceased to the applicant. He has stated that the co-accused, Ratan Yadav, caused fatal injury by axe on the head of the deceased, Anuj. The applicant was generally implicated and assigned weapon by the aforesaid witness, Deepak Mishra. The statements of the witnesses referred above have been recorded after rejection of the first bail application of the applicant. Earlier his role was not clear.
¶8Keeping in view the nature of the offence, evidence, complicity of the accused; submissions of the learned counsel for the parties noted above; finding force in the submissions made by the learned counsel for the applicant; keeping view the uncertainty regarding conclusion of trial; one sided investigation by police, ignoring the case of accused side; applicant being under-trial having fundamental right to speedy trial; larger mandate of the Article 21 of the Constitution of India; considering the dictum of Apex Court in the case of Satendra Kumar Antil vs. C.B.I., passed in S.L.P (Crl.) No. 5191 of 2021; considering 5-6 times overcrowding in jails over and above their capacity by the under trials and without expressing any opinion on the merits of the case, the Court is of the view that the applicant has made out a case for bail.
