Judgment
Court No. - 1 Case :- MATTERS UNDER ARTICLE 227 No. - 9268 of 2023 Petitioner :- Smt. Parkhi Respondent :- Shri Sohanbir Singh Counsel for Petitioner :- Rajeev Kumar Pal Hon'ble Jayant Banerji,J.
¶1Heard learned counsel for the petitioner.
¶2This petition has been filed for a direction to the Additional Principal Judge, Family Court No.1, Muzaffar Nagar to decide Case No. 431 of 2021 ( Smt. Parkhi and others Vs. Sri Sohanbir Singh) expeditiously and within a stipulated period.
¶3The contention of the learned counsel for the petitioner is that the aforesaid case was filed under Section 19 of the Hindu Adoption and Maintenance Act by the petitioner, who is the daughter-in-law of the defendant-respondent, seeking maintenance. The contention is that the written statement was filed by the defendant and the issues were framed and cross examination of DW-1 is yet to be concluded. It is stated that in the meanwhile, an application 54-C was filed by the defendant on 22.5.2023 with the prayer that the petitioner may submit her expenditure in support of her claim of maintenance. In response of which, the petitioner has also filed objection and now the matter has been fixed for disposal of the application 54-C.
¶4I have perused the order sheet. It is evident that the Family Court is proceeding with the matter and no unnecessary adjournments are being granted. It appears that the application 54-C is pending disposal
¶5This Court has no reason to doubt that the Family Court is proceeding with the matter with due expedition as with the other matters within its jurisdiction. As such, no interference is required in this matter.
¶6This petition is, accordingly, disposed of.
¶7Registrar (Compliance) is required to send a copy of this order to the concerned court within fifteen days. Order Date :- 18.10.2023 sfa/ (Jayant Banerji, J) High Court of Judicature at Allahabad
