This writ petition has been filed to direct the Deputy Director of Consolidation, Kanpur Nagar, respondent no.2 to decide the recall/restoration application of petitioner dated 18.12.2018 filed in Reference No.29 (Laxmi Narayan Vs. State) under Section 48 (3) of U.P. Consolidation of Holdings Act, 1953 read with Rule 109 within stipulated period. Taking note that before Authority concerned, on various dates the Advocates have not appeared on the ground of their call for abstention from judicial work, therefore, petitioner is directed to appear himself or through his Advocate and shall not take any adjournment on each and every date, whenever the case is listed. This writ petition is disposed of with direction to the Deputy Director of Consolidation, Kanpur Nagar, respondent no.2, that he shall take endeavour to decide the aforesaid recall/restoration application expeditiously within a period of three months, in accordance with law, if there is no legal impediment taking note of the judgment passed by Full Bench of this Court in Smt.
