¶1Heard learned counsel for the parties.

¶2By means of this petition petitioner prays for quashing of the order dated 16.01.2023 passed in Summary Court Martial proceedings and, therefore, the petitioner has an alternative efficacious remedy to approach the Armed Force Tribunal constituted under the Armed Forces Tribunal Act, 2007.

¶3Having perused the pleadings raised by the petitioner and order impugned, the Court is of the view that since the matter relates to Indian Army Services, therefore, the petitioner should first approach the Armed Forces Tribunal.

¶4In view of the above, the petitioner is at liberty to approach the Armed Force Tribunal constituted under the Armed Forces Tribunal Act, 2007.
