Judgment

Court No. - 6 Case :- WRIT - C No. - 29249 of 2023 Petitioner :- Smt. Sharda Devi Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Geetam Singh Counsel for Respondent :- C.S.C.,Arjun Prasad Yadav Hon'ble Mrs. Manju Rani Chauhan,J. Heard Mr. Geetam Singh, learned counsel for the petitioner, Mr. Arjun Prasad Yadav, learned counsel for the respondent no.5 and learned Standing Counsel for the State-respondent. This writ petition has been filed by the petitioner with a prayer to quash the impugned notice dated 06.05.2015 issued by respondent no.3 for recovery of Rs.2,69,564.50/- alongwith interest. At the very outset, learned counsel for the respondent no.5 submits that pursuant to the aforesaid notice of the year 2015, recovery citation has already been issued way back in the year 2021. Even otherwise, the petition has been filed at a highly belated stage, i.e. after about 8 years without explaining delay and laches. Therefore, no interference is required. In view of the above, the writ petition is liable to be dismissed on the ground of delay and laches. Accordingly, the writ petition being devoid of merit is dismissed. Needless to say that in case the petitioner approaches the concerned authority to provide the recovery citation, the needful may be done.
