¶1Heard learned counsel for the petitioner as well as learned Standing Counsel.

¶2Petitioner, who is presently posted as Head Constable in Civil Police at district-Barabanki is claiming third promotional pay scale benefit/ grade pay and consequential fixation of his pay in terms of the recommendation of 7th Pay Commission for having completed 26 years of service.

¶3It is argued on behalf of the petitioner that as per the rules an employee who completes 26 years of service becomes entitled to the benefits under Assured Career Progression Scheme for the third time known as IIIrd A.C.P.

¶4In support of the above argument learned counsel for the petitioner has relied upon Government Order dated 21.07.2011, whereunder, services rendered by the petitioner during training period is also liable to be taken into account towards qualifying service for ACP benefit to which an employee would be entitled as per the guidelines and Government Order. The Government order has issued on 21.07.2011 is reproduced hereunder: "उ्ቈर ्ቚददेश गगृह पपुललिस अनपुभभाग-2 ससंख्यभा-ररट-1634/6-पपु-2-11-1600 (5)/2011 लिखनऊ ददनभासंक-21 जपुलिभाई, 2011 कभायभा቟ኋलिय ग्यभाप्ቚ ददेश कदे पपुललिस बलि कदे आरककशयोሱ कदे ्ቚदशकशण ककी अवलधि कको उनककी सदेवभा मम जकोड़नदे एवसं तदनपुसभार उन्हम स्तरको्ቐयन (ए०ससी०पसी०) अनपुमन्य दकयदे जभानदे हदेतपु कम቟ኋचभाररयोሱ दभारभा अनदेक ररट यभादचकभायम मभाननसीय उच्च न्यभायभालिय मम यकोलजत ककी गयसी हहै। कपुछ ररट यभादचकभाओसं मम मभाननसीय उच्च न्यभायभालिय दभारभा दनण቟ኋय पभाररत दकयदे गयदे हहै तथभा कपुछ अवमभाननभा यभादचकभायम भसी दभालखलि ककी गयभा हहै। उ्ሹ कस्थदत कको दृदቖኌगत रखतदे हहए सम्यक दवचकोपरभान्त महभामदहम शसी रभाज्यपभालि ददनभासंक 8.6.1998 सदे पपूव቟ኋ एवसं ददनभासंक 17.09.2002 सदे 02.12.2009 ककी अवलधि मम ्ቚदशकशण पभायदे आरककशयोሱ ककी ्ቚदशकशण अवलधि कको उनकदे सदेवभाकभालि मम जकोड़नदे एवसं तदनपुसभार उन्हम स्तरको्ቐयन, (ए०ससी०पसी०) अनपुमन्य दकयदे जभानदे हदेतपु इस ्ቚदतबन्धि कदे अधिसीन सहर቟ኋ स्वसीकगृदत ्ቚदभान करनदे हहै दक उ्ሹ सपुदवधिभाओसं कदे अदतरर्ሹ अन्य दकससी ्ቚकभार ककी सपुदवधिभा जको उन्हम अब तक अनपुमन्य नहसी हहै, ्ቚदभान नहीሻ ककी जभायदेगसी।

¶2यह आददेश दव्ቈ (व्यय दनयसं्ቔण) अनपुभभाग-12 ककी अशभासककीय प्ቔ ससंख्यभा-ई-12-1727/दस-2011 ददनभासंक 21 जपुलिभाई, 2011 मम ्ቚभा्቎ उनककी सहमदत सदे जभारसी दकयदे जभा रहदे हह। वकपुसंवर फतदेह बहभादपुर्ቚ मपुख सदचव, गगृह"

¶5It is submitted by learned counsel for the petitioner that in the above regard, he has already approached the authority competent in the matter vide representation dated 13th July, 2023, copy whereof has been brought on record as Annexure No. 6 to the writ petition.

¶6Learned Standing Counsel submits that the matter can be directed to be considered by the authority concerned.

¶7In view of the above, this petition stands disposed of with a direction to the competent authority to look into and consider the grievance of the petitioner as raised in his representation dated 13th July, 2023 and decide the same within a period of two months from the date of receipt of certified copy of this order.
