The applicant is in jail since 12.08.2023. The bail application of the applicant was rejected by the learned trial court on 29.08.2023. The following arguments made by Shri Anuj Bajpai, learned counsel and Shri Om Prakash Singh, learned on behalf of the applicant, which could not be satisfactorily refuted by Shri Paritosh Kumar Malviya, learned AGA from the record, entitle the applicant for grant of bail:
¶1The applicant is the husband of the deceased. He was nominated due to strained relations with his father-in-law.
¶2The medical report drawn up by the Community Health Centre where the victim was first examined medically opines that there was only one injury which was near the eye of the deceased.
¶3The deceased was not assaulted brutally, inasmuch as, she travelled by foot to his father's house after a normal altercation between the couple.
¶4Nature of the injuries shows that there was no intent to kill.
¶5Delay in providing medical attention to the deceased was the cause of the death of the latter. The death was in her father's house for four days prior to her death.
¶6Prosecution evidence does not connect the applicant with the offence.
¶7The applicant does not have any criminal history apart from the instant case.
¶8The applicant is not a flight risk. The applicant being a law abiding citizen has always cooperated with the investigation and undertakes to join the trial proceedings. There is no possibility of his influencing witnesses, tampering with the evidence or reoffending.
