Judgment
Court No. - 34 Case :- WRIT - A No. - 17187 of 2023 Petitioner :- Ganga Singh Arya Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Birendra Singh Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard learned counsel for the parties and perused the record. Petitioner, who is a third party, is praying for issuing a direction to the Additional Director of Police, Agra Region, Agra to take an appropriate action pursuant to the letter dated 18th February, 2020 written by Additional Director General of Police, Establishment, Police Head Quarter, U.P. Learned Standing Counsel has raised preliminary objection regarding maintainability of the writ petition at the instance of third party as no public interest litigation is entertainable in the service matter. Upon a pointed query being made, learned counsel for the petitioner could not demonstrate before this Court nor, could cite any authority of law, which permits maintainability of such petition in service matter. It is well settled that in service jurisprudence there is a contract of employment between the employer and employee and no third party is required to interfere. Petition fails and is, accordingly, dismissed. Order Date :- 18.10.2023 Atmesh High Court of Judicature at Allahabad
