Case no.
WRIA 17702/2023

Judgment

Court No. - 34 Case :- WRIT - A No. - 17702 of 2023 Petitioner :- Sunil Kumar Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Daya Shankar,Mahendra Kumar Mishra Counsel for Respondent :- C.S.C,Pranjal Mehrotra Hon'ble Ajit Kumar,J. Petitioner, who was earlier working as Block Program Manager under the National Health Mission Program on a contractual basis was disengaged in the year 2017. It appears that he has moved some application in the year 2023 to permit him to resume his duties taking into consideration his previous service. Sri Pranjal Mehrotra, learned Advocate appearing for the respondents submits that there is no vested right created in favour of the contractual employee once the contract of employment comes to an end. He submits that there is no re-engagement on the contract basis unless the authorities proceed to make such engagement by issuing notification. Having heard learned counsel for the respective parties and having perused the record, I find that the petitioner was dis-engaged from his contractual employment in the year 2017. He remained silent for over these years and has now moved some application/ representation for re-engagement. I do not find any justification for consideration of his application unless and until there is some notification issued by the respondents for inviting application. However, it is provided that in the event respondents invite application, petitioner may apply the same and in that circumstances, his matter may be considered. As of now, no cause arises. However, it will remain open for the petitioner to apply afresh as and when advertised by the respondents for such appointment. Subject to aforesaid liberty, this petition fails, consigned to records. Order Date :- 18.10.2023 IrfanUddin High Court of Judicature at Allahabad
