Heard learned counsel for the parties and perused the record. Petitioner has approached this Court seeking direction to the State Public Service Commission to pass orders upon his application dated 4th August, 2023 to disclose her marks obtained by her in the selection held by the U.P. Public Service Commission for the post of Staff Nurse pursuant to the advertisement issued in the year 2017. Sri Nisheeth Yadav, learned counsel appearing for the Public Service Commission has drawn the attention of the Court to the press notification issued on 16th April, 2019 by the U.P. Public Service Commission in which the date was notified between 17th April, 2019 and 23rd April, 2019 for the candidates, who had participated in the selection to login at the website of the U.P. Public Service Commission to obtain the results/ marks in the relevant examination and no separate application accordingly shall be issued. In view of the above, I do not find any justification to pass orders for the U.P. Public Service Commission to take decision upon the pending application inasmuch as petitioner has approached this Court after a lapse of 7 years and, therefore, petition is also barred by delay and laches.
