Instructions filed today be kept on record. This writ petition has been filed against the impugned demand notice dated dated 28.12.2020 issued by respondent no.4. Sri Ashish Dwivedi holding brief of Sri Baleshwar Chaturvedi, learned counsel for the Electricity Department states that the final assessment order has been passed on 9.11.2022. He categorically stated that against that final assessment order, appeal lies u/s 127 of the Electricity Act, 2003. We do find substance in the submission made by learned counsel for the Electricity Department. If the petitioner is aggrieved against the final assessment order, he may file an appeal u/s 127 of the Electricity Act, 2003 within a period of 15 days from today and the same shall be decided within a period of two months thereafter without going to the question of limitation.
