The applicant has invoked the jurisdiction of this Court under section 482 Cr.P.C. with a prayer to direct Principal Judge Family Court, Bhadohi, Gyanpur to consider and decide the application under section 128 Cr.P.C. dated 4.4.2023 and also to execute/implement the order dated 24.2.2023 passed by Principal Judge, Family Court Bhadohi, Gyanpur in Criminal Case NO. 57/22 Sony Begam Vs. Kasim Shah under section 125 Cr.P.C. within the stipulated period.. Learned counsel for the applicant has submitted that the applicant is wife of O.P. No.2 and she has filed Execution Case, under section 128 Cr.P.C. for enforcement of order of maintenance granted to her vide order dated 24.2.2023 on the basis of which the instant case has been instituted but the same has not yet been decided and has been lingering-on, on one pretext or the other. In view of above, court below is expected to make all endeavour to decide the aforesaid case expeditiously preferably within a period of three months after giving opportunity of hearing to both the sides and without giving unnecessary adjournments to either side, if there is no other legal impediment in deciding the aforesaid case.
