¶1Heard Sri Ram Chandra Srivastava, learned counsel for the petitioner and Sri Vinod Rai, learned Standing counsel appearing on behalf of respondent nos. 1 to 4 as well as Sri Sudhir Bharti, learned counsel for respondent no. 5.

¶2Present petition has been filed seeking a direction in the nature of mandamus to be issued in favour of the respondents to remove illegal encroachment carried over arazi no.64 which was allotted to the petitioner as residential patta.

¶3Today when the matter has been taken up, learned Standing Counsel came up with the specific instructions which is taken on record through which it has been transpired that for cancellation of patta which was allotted to the petitioner, respondent no.6 preferred a case bearing Case No.D202305200001384 (Shailendra Vs. Kanti and others), under Section 66 of U.P. Revenue Code, 2006 which is still pending to be adjudicated by respondent no.2 and as such, the prayer as sought through the instant petition cannot be granted.

¶4However, the petitioner is directed to put her appearance till

21.11.2023

before

respondent

no.2

in

Case No.D202305200001384 (Shailendra Vs. Kanti and others), under Section 66 of U.P. Revenue Code, 2006 for ventilating her grievances and till 21.11.2023, all the parties are directed to maintain status quo over the plot in question.
