Act, P.S. Madnapur, District Shahjahanpur.. In the aforesaid F.I.R., four persons namely Anand (husband), Maya (mother-in-law), Shivani (nand) and Baleshwar (father-in-law) have been nominated as named accused. Learned counsel for the applicant submits that applicant is the mother-in-law of the deceased. Marriage of the parties was solemnized on 5.7.2017, whereas the occurrence giving rise to the present criminal proceedings occurred on 31.3.2023 i.e. after more than 5 years and 8 months of marriage. The deceased was a short tempered lady and she has taken the extreme step of terminating her life by committing suicide by hanging herself. Bona fide of the applicant is explicit from the fact that except for the ligature mark, no other ante mortem injury was found on the body of the deceased. Even otherwise, applicant is the mother-in-law of the deceased, therefore, the applicant being a lady is entitled to the benefit of the provisions contained in proviso to Section 437 Cr. P. C. The father-in-law of the deceased i.e. husband of applicant has already died. Son of the applicant is also languishing in jail. Applicant cannot be said to be beneficiary of the alleged demand of dowry. Even otherwise, applicant is a woman of clean antecedents, inasmuch as she has no criminal history to her credit except the present one. Applicant is in jail since 04.04.2023. As such, she has undergone more than 6 months of incarceration. The police report in terms of Section 173 (2) Cr. P. C. has already been submitted. Therefore, the entire evidence sought to be relied upon by the prosecution against applicant stands crystallized. However, upto this stage, no such circumstance has emerged necessitating the custodial arrest of applicant during the pendency of trial. As such the applicant is liable to be enlarged on bail. Moreover, in case, applicant is not enlarged on bail, a happy family shall stand broken. In case, the applicant is enlarged on bail, he shall not misuse the liberty of bail and shall co-operate with the trial. In case, applicant is enlarged on bail, she shall not misuse the liberty of bail and shall co-operate with the trial. Per contra, the learned A.G.A. and the learned counsel representing first informant have opposed the prayer for bail. However, they could not dislodge the factual/legal submissions urged by the learned counsel for applicant with reference to the record at this stage. Having heard the learned counsel for applicant, the learned A.G.A. for state, the learned counsel representing first informant upon perusal of material brought on record, nature and gravity of offence, evidence, complicity of the accused, accusation made and coupled with the fact that the applicant is mother-in-law of the deceased, applicant being a lady is entitled to the benefit of the provisions contained in proviso to Section 437 Cr.
