Judgment

Court No. - 45 Case :- CRIMINAL MISC. WRIT PETITION No. - 15017 of 2023 Petitioner :- Arvind Pal Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Santosh Kumar Singh Counsel for Respondent :- G.A.,Pavan Kumar Hon'ble Vivek Kumar Birla,J. Hon'ble Vinod Diwakar,J.

¶1Heard Shri Santosh Kumar Singh, learned counsel for the petitioner, Shri Pradeep Kumar holding brief of Shri Pawan Kumar, learned counsel for the informant as well as Shri G.P. Singh, learned AGA for the State.

¶2Present petition has been preferred with the prayer to quash the impugned First Information Report dated 27.04.2023, registered as Case Crime No.0161 of 2023, under Sections 147, 384, 306, 389, 504, 506 IPC, Police Station Navabad, District Jhansi. Further prayer has been made not to arrest the petitioner pursuant to impugned FIR.

¶3Learned AGA submits that chargesheet no.170 of 2023 has already been forwarded on 25.06.2023 against accused Seema Yadav and Km. Priya Yadav whereas Rakesh Sahu and Naveen Yadav have been exonerated. It is further submitted that accused Gyan Singh and Arvind Pal are absconding and proceedings under Section 82 Cr.P.C. have been initiated against them. Learned AGA next submitted that petitioner is not co-operating in the investigation and chargesheet cannot be quashed in part, therefore, writ petition is liable to be dismissed.

¶4We find substance in the argument of learned AGA.

¶5The writ petition is devoid of merit and is accordingly dismissed. Order Date :- 18.10.2023 Nitendra High Court of Judicature at Allahabad
