The present first bail application has been filed on behalf of the applicant in Case Crime No. 669 of 2023, under Sections 392 and 411 I.P.C. Police Station Bisrakh, District Gautam Budh Nagar with the prayer to enlarge him on bail. Learned counsel for the accused-applicant submitted that the applicant is innocent and has been falsely implicated in the instant case due to malafide intentions. The applicant was not named in the first information report. His name as an accused in the present case surfaced for the first time in the confessional statements of co-accused Tarun and Chandra Prakash. He further submits that looted articles have been recovered from the possession of the co-accused Tarun and Chandra Prakash. No incriminating article or material has been recovered either from the applicant or on his pointing out. The role of the applicant is shown in the recovery memo that Rs 1000/-was transferred in the account of applicant through paytm. The offence is triable by the Magistrate. Applicant is having no criminal history and he is languishing in jail since 17.8.2023 and if he is granted the liberty of bail he will not misuse the same and he is ready to furnish his sufficient sureties, bonds and personal bonds.
