Sri Arvind Prabodh Dubey, learned counsel for petitioner submits that grievance of petitioner could be satisfied in case the order impugned be modified only to extent that instead of allotted chak i.e. Gata No.428, petitioner may be allotted plot No.430 which is a land reserved for Harijan Abadi and for Harijan Abadi Gata No.428 may be earmarked i.e. chaks be interchanged. Learned counsel further submits that if such modification is carried out, no prejudice would cause to respondents as even area of gata No. 428 is slightly larger than that of gata No. 430. The petitioner would use his irrigation facility as chaks would be connected to each other. This writ petition is disposed of with liberty to the petitioner to file a modification application in aforesaid terms before Deputy Director of Consolidation within a period of seven days from today and in event if any such application is filed, the Deputy Director of Consolidation shall decide the same within a period of two weeks thereafter.
