¶1Heard Sri Avadesh Kumar Yadav, Advocate holding brief of Sri Sundeep Shukla counsel for the petitioner and learned AGA for the State-respondents.

¶2The instant petition under Article 227 of the Constitution of India has been filed for direction to the Additional Principal Judge, Family Court, Second District-Gorakhpur to decide the Case No. 870 of 2021 (Smt. Laxmi Singh & Anr. Vs. Bheem Singh) filed under Section 127 Cr.P.C. within stipulated period of time.

¶3Counsel for the petitioner states that aforesaid case is pending since 2021. Copy of the order sheet has been annexed as Annexure No.5 to this petition, in order to demonstrate that the case is not proceeding expeditiously.

¶4In view of the facts and circumstances of the case, without expressing any opinion on the merits of the case, this petition is disposed of with the direction to the Additional Principal Judge, Family Court, Second District-Gorakhpur to decide the Case No. 870 of 2021 (Smt. Laxmi Singh & Anr. Vs. Bheem Singh) filed under Section 127 Cr.P.C as expeditiously as possible, preferably within a period of six months, from the date of production of a certified copy of this order.
