From the perusal of the record, it appears that the petitioner has already approached the Debt Recovery Tribunal for the proceedings which were undertaken by the Bank under The Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (hereinafter referred to as the "Act"). Now an order has been passed under Section 14 of the Act for taking of possession. The petitioner may by amending the secutrization application agitate the matter before Debt Recovery Tribunal, Lucknow itself. Under such circumstances, no interference is warranted. The writ petition is dismissed. However, we provide that if the petitioners move an application for interim relief, the same may be decided within a period of one week from the date of filing of the application.
