This writ petition has been filed with a prayer that the auction notice dated 20.07.2023 for the auction of the petitioner's mortgaged property be quashed. Learned counsel for the petitioner states that the auction was to take place on 23.08.2023 but the auction on that date had failed as no bidder was there. He further states that no further date for auction has been fixed. He further states that be petitioner be given one more opportunity to negotiate the matter with the bank so that the petitioner can pay off the outstanding dues which are payable. Learned counsel for the respondent bank does not dispute the fact that the auction slated for 23.08.2023 had failed and he also does not dispute the fact that no further date for auction is fixed. Under such circumstances, we provide that the petitioner may negotiate with the bank for the payment of the outstanding dues which are being demanded from the petitioner.
