¶1Heard learned counsel for the petitioners and the learned standing counsel for the state-respondents.

¶2The instant writ petition has been filed, seeking a writ of mandamus, commanding respondent no.2/Sub Divisional Magistrate, Sadar, Gorakhpur to decide Case No.15098/2022

Case No.T202005310315098) (Sushant Prasad and Others vs. State and Another), within the stipulated time.

¶3Counsel for the petitioners states that the aforementioned suit is pending before respondent no.2 since 2020. Copy of the order sheet has been annexed as Annexure No.4 to the writ petition, in order to demonstrate that the case is not proceeding expeditiously.

¶4In view of the facts and circumstances of the case, without expressing any opinion on the merits of the case, this petition is disposed of with the direction to respondent no.2 to decide the aforesaid proceedings to its logical conclusion, as expeditiously as possible, preferably within a period of 6 months, from the date of production of a certified copy of this order before the authority concerned, without granting unnecessary adjournments to either of the parties, in accordance with law.
