Judgment

Court No. - 52 Case :- WRIT - C No. - 35034 of 2023 Petitioner :- Prem Shanker Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Sharad Kumar Counsel for Respondent :- CSC Hon'ble Saurabh Srivastava,J.

¶1Heard Sri Sharad Kumar, learned counsel for petitioner and learned Standing counsel for State respondents.

¶2Present petition has been filed seeking following reliefs: "(i) Issue a writ order or direction in the nature of mandamus directing the respondent no. 2 to consider the claim of the petitioner as well as decide the representation of the petitioner dated 18.03.2023."

¶3It is the case of the petitioner that for cancelling the name of respondent no. 4 and 5 from revenue records petitioner has preferred representation dated 18.03.2023 which is pending and petitioner has preferred this petition seeking direction in favour of respondents for expeditious disposal of the said representation.

¶4Learned Standing counsel vehemently opposed the prayer made through the instant petition.

¶5After hearing the rival submissions and perusing the records, it is crystal clear that petitioner has neither initiated any proceedings against respondent no. 4 and 5 nor he has availed any remedy as available in the statutory rules for redressal of his grievances and as such prayer sought through the instant petition cannot be acceded being not maintainable.

¶6Writ petition stands dismissed accordingly. Order Date :- 18.10.2023 Shaswat High Court of Judicature at Allahabad
