¶1Heard learned counsel for the applicant and perused the record.

¶2The only prayer made by the counsel for the applicant to direct the court below to decide the Bail Application dated 01.05.2023 in Session Trial No. 252 of 2019 (State vs. Arun Gaur) arising out of Case Crime No. 252 of 2019, under Section 302, 201, 394, 411 I.P.C., Police Station Lohta, District Varanasi, pending in the court of Additional District & Sessions Judge/ Special Judge POCSO Act, Varanasi within stipulated period.

¶3Learned A.G.A. has no objection.

¶4Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present Application U/S 482 Cr.P.C. stands disposed of finally with a direction to the court below to consider and decide the aforesaid bail application in accordance with law most expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
