Judgment

Court No. - 21 Case :- WRIT - C No. - 36500 of 2023 Petitioner :- Radheyshyam Sharma And Another Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Paritosh Sukla Counsel for Respondent :- C.S.C.,Krishna Kant Singh Hon'ble Manoj Kumar Gupta,J. Hon'ble Donadi Ramesh,J.

¶1The instant petition has been filed praying for quashing of the Government Order dated 19.03.2015, which lays down the guidelines for purchase of land from tenure holders on basis of negotiation when the land is required for public purposes. The petitioners have also prayed for mandamus to respondent No. 3 to give employment to their legal heirs as petitioners claim that after acquisition of their land they would be rendered landless.

¶2Counsel for the petitioners admits that there is no formal notification for acquisition of the land of the petitioners. He points out that respondents had issued a public notice dated 19.05.2023 mentioning that certain land is required for construction of airport and the process for acquiring the said land through negotiation is in progress. Counsel for the petitioners further submits that the petitioners are ready to transfer their land in favour of the State provided the State promises to give employment to their legal heirs.

¶3Since the acquisition is not being made under any Act but on basis of mutual negotiation, therefore, this Court cannot compel any party to agree on any particular term or condition.

¶4The petition is wholly misconceived and is accordingly dismissed. Order Date :- 19.10.2023 Mukesh Kr. (Donadi Ramesh,J.) (Manoj Kumar Gupta,J.) High Court of Judicature at Allahabad
