Undisputably, a civil suit between the parties is pending. Simultaneously, an application for mutation has been filed before respondent no.3. Grievance of the petitioners is that their mutation application has not been decided since last eight months. He submits that a direction may be issued to respondent no.3 for deciding mutation proceedings expeditiously. Counsel appearing for respondent no.3 submits that unless the civil suit is decided, the mutation proceedings cannot be decided. Be that as it may, once the proceedings are pending before the Competent Authority, the said Authority is obliged to pass appropriate orders thereon in accordance with law, considering the all facts and circumstances of the case, after giving due opportunity of hearing to the petitioners.
