¶3This bail application under Section 439 of Code of Criminal Procedure has been filed by the applicant-Geeta Saran, seeking enlargement on bail during trial in connection with Case Crime No.248 of 2023 under Sections 304-B, 498-A IPC and 3/4 Dowry Prohibition Act, registered at Police Station Katra, District Shahjahanpur.

¶5Office is directed to trace out the same and place it on record and also make a note in the order sheet regarding the same.
¶6Learned counsel for the applicant argued that the applicant has been falsely implicated in the present case. It is argued that the applicant is the father-in-law of the deceased. The marriage of the deceased Kavita with Nagendra @ Neeraj, the son of the applicant was solemnized four years back. It is argued that general and omnibus allegations have been made in the FIR against the applicant and his family members. As per postmortem report, the deceased died due to asphyxia as a result of ante-mortem hanging and there was only single ligature mark on the body of the deceased. Nagendra @ Neeraj, the husband of the deceased is in jail. While placing para 22 of the affidavit, it is argued that the applicant is aged about 67 years. It is also pointed out that the applicant has no criminal history as stated in para 30 of the affidavit and is in jail since 14.6.2023.
¶7Per contra learned counsel for the State vehemently opposed the prayer for bail and argued that the applicant is named in the FIR. Since the applicant is the father-in-law of the deceased, he was the head of the family and was responsible for setting things right, as such prayer for bail be rejected.
