¶1Matter taken up in the revised list. No one appears on behalf of the appellant to press this appeal despite the fact that there are four learned counsels appearing on behalf of the appellant. Sri Ajay Singh, learned A.G.A-I for the State is present.

¶2The present appeal has been preferred by the appellant against the judgment and order dated 27.01.1983 passed by VIth Additional Sessions Judge, Gorakhpur, in Sessions Trial No. 154 of 1978.

¶3As per the office report dated 04.10.2023, a report of C.J.M. Kushinagar dated 04.10.2023 has been received stating therein that the sole appellant (Mustaqeem) has died. The said report has been sent after due inquiry.

¶4This Court has perused the said report which states that the accused-appellant has died.

¶5In view of the above, the appeal stands abated.
