¶1Matter taken up in the revised list. No one appears on behalf of the appellant to press this appeal despite the fact that there are five learned counsels appearing on behalf of the appellant. Sri Ajay Singh, learned A.G.A-I for the State is present.

¶2The present appeal has been preferred by the appellant against the judgment and order dated 28.02.1983 passed by VI Additional Sessions Judge, Gorakhpur, in Session Trial No. 26 of 1975.

¶3As per the office report dated 10.10.2023, a report of C.J.M. Gorakhpur dated 30.09.2023 has been received stating therein that the sole appellant (Ram Pati Singh) has died. The said report has been sent after due inquiry.

¶4This Court has perused the said report which states that the accused-appellant has died.

¶5In view of the above, the appeal stands abated.
