Judgment
Court No. - 6 Case :- WRIT - C No. - 27679 of 2023 Petitioner :- National Insurance Company Limited Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Ashok Kumar Srivastava Counsel for Respondent :- C.S.C. Hon'ble Mrs. Manju Rani Chauhan,J. The instant petition has been filed with a prayer to direct respondent no. 2 to quash the impugned order dated 14.03.2023 passed by the Motor Accident Claims Tribunal, Mathura in MACP No. 592 of 2014. Learned counsel for the petitioner submits that he has not challenged the award on merits and submits that some fraud has been played by respondent no. 3, therefore, an application has been moved for getting the matter investigated by the S.I.T., however, without waiting for final orders on the application, impugned award has been passed. Learned Standing Counsel submits that against the award, impugned herein, the writ petition is not maintainable in view of the provisions of Section 173(2) of the Motor Vehicles Act, 1988. In view of the above, the writ petition is misconceived. It is accordingly dismissed. No order as to costs. Order Date :- 19.10.2023 Arti High Court of Judicature at Allahabad
