Heard learned counsel for the petitioner, learned counsel for the State-respondent and Sri Nilamber Tripathi, learned counsel for respondent nos.2 and 3. According to the petitioner, arbitration proceedings are pending before this Court. However, due to death of arbitrator, there is no substantial progress in the case. Learned counsel for the petitioner submits that an application for appointment of fresh arbitrator has already been filed but till appointment of new arbitrator, limited protection may been granted to the petitioner so that his property may not be demolished. Learned counsel appearing for the Prayagraj Development Authority has no objection to the aforesaid proposition. Without expressing any opinion on merits of the case, the writ petition is disposed of permitting the petitioner to pursue his application for appointment of new arbitrator.
