¶1Heard Shri Sanjeet Kumr Mishra, learned counsel for the petitioner as well as Shri G.P. Singh, learned A.G.A. for the State respondent.

¶2Present petition has been filed with a prayer to quash the order dated 06.09.2023 passed by the Additional Police Commissioner, Commissionerate, Ghazaibad in Case No. 434 of 2023, under Section 2/3 of U.P. Control of Goonda Act, 1970, Police Station Masuri, District Ghaziabad.

¶3Admittedly, against the internment order impugned herein, the petitioner has already availed statutory remedy by way of filing an appeal under Section 6 of the U.P. Control of Goondas Act, 1970, which is still pending.

¶4In the facts and circumstances of this case, present petition stands disposed of with a direction to the respondent no. 2-Commissioner, Mandal Meerut, District Meerut to hear and decide the said appeal of the petitioner, in accordance with law by reasoned and speaking order, as expeditiously as possible, preferably within a period of two months from the date of filing of a certified copy of this order before the respondent no. 2.
