Judgment

Court No. - 43 Case :- CRIMINAL MISC. WRIT PETITION No. - 16618 of 2023 Petitioner :- Chandrajeet Yadav Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Rajesh Maurya Counsel for Respondent :- G.A. Hon'ble Anjani Kumar Mishra,J. Hon'ble Rajendra Kumar-IV,J.

¶1Heard learned counsel for the petitioner as well as learned A.G.A. for the State.

¶2The instant writ petition seeks quashing of the FIR dated

29.09.2023 giving rise to Case Crime No.0166 of 2023, under Sections 406, 420, 467, 468, 385, 504, 506 I.P.C., Police Station-Dullahpur, District-Ghazipur.

¶3The contention of counsel for the petitioner is that the First Information Report is concocted and fabricated. However, upon perusal of the record, we find that it contains ingredients of cognizable offence because alleged money is alleged to have changed hands on the basis of threats extended by the petitioner.

¶4Moreover, the allegations made in the First Information Report clearly disclose commission of cognizable offences and the allegations are serious in nature. Therefore, prayer of the petitioner to quash the First Information Report is completely misconceived and is rejected.

¶5The writ petition is therefore dismissed. Order Date :- 19.10.2023 Anjali High Court of Judicature at Allahabad
